Turning off the layer toolbar

Turning off the layer toolbar hides the layers until browsing to any location. The layer bar then appears but the layer menu item in the view/toolbar flyout does not have a check mark next to it. Selecting said menu item will add the check mark, selecting it again will remove the layer toolbar until browsing again.

What KM version? More info please.
